Terms & Conditions

Home Terms & Conditions

The Hirer shall be responsible for all items hired from the time they are picked up or delivered, and shall pay for any item broken, damaged, lost, or stolen during the hire period. The security of hired items is the Hirer’s responsibility until the items are returned or collected by RBR Party and Event Hire (RBR). If any item is item broken, damaged, lost, or stolen it is the Hirer’s responsibility to pay for the items at the current replacement cost.

DEPOSIT: A 30% deposit is required before any booking will be confirmed. The deposit is non-refundable. In the event of the Hirer holding an account, the deposit amount will be billed accordingly.

CLEANING: All items are to be returned clean otherwise the Hirer will be charged an additional cleaning fee. The cleaning fee is the same rate as the hire. An additional charge will be made for any goods not returned or made available for collection by RBR as arranged.

PAYMENT: All invoices are to be paid in full before collection or delivery unless the Hirer has an established credit account. The cost associated with paying by credit card is 1%. Amex and Diners cards are NOT accepted.

INDEMNITY: The Hirer shall indemnify and keep indemnified and save harmless RBR and RBR’s servants and agents from all damages, suits, actions, claims, and demands of every description whatsoever arising directly or indirectly from the use, maintenance, transport, operation of the goods or otherwise or whether resulting from negligence of RBR, it’s servants or agents or otherwise.

EXCLUSION OF LIABILITY: RBR shall not be liable to the Hirer or the Hirer’s servants or agents for any damages, suits, actions, claims, and demands of every description whatsoever arising directly or indirectly from the representations warranties, terms and conditions, express or implied (exception in so far as statutory conditions and warranties cannot be excluded under part V Division 2A of The Trade Practices Act (1974) or relevant State Legislation), use maintenance, transport, operation of the goods or otherwise and whether resulting from the negligence of RBR, it’s servants or agents or otherwise.

BOND: If a bond has been charged the bond will be held by RBR until the hired items have been checked by RBR. The remaining portion of the bond less the cost of any cleaning, damaged, lost, or stolen items will be returned to the Hirer. The bond will be retained by RBR if Jukeboxes or Slushy machines are transported in any form of utility vehicle, trailer, or on the back seat or passenger seat of vehicle.

INSURANCE: The Hirer will ensure that all items are adequately insured under their own policy. RBR does not insure any of the items. The Hirer bears all risk in relation to the return of all items in the same order they were received.

EXTENDED HIRE: The Hirer must return the items (or make available for RBR to collect) when it is due or there will be a continuing hire charge until it is returned. This applies to part orders where single items are not returned.

CANCELLATION AND VARIANCE OF GOODS:  If the event is cancelled, the minimum due is the 30% deposit that is payable on booking. If there is an account, the 30% deposit will be billed to the account in the event of a cancellation.  If the cancellation is within one month of the event occurring, the total cost of the invoice is payable; this includes but is not limited to inclement weather, bushfires, floods, pandemic and/or any circumstance resulting in the failure to deliver that is the fault of any other agency, organisation, body, or party and is not the fault of RBR. No variation of the order will be greater than a 10% reduction of the original invoice value. If the variation is greater than 10% than the Hirer agrees to pay 90% of the original invoice value.

DELIVERY: The Hirer agrees that there is truck access directly to the jobsite. Any costs incurred in having to transport the goods from the truck to the jobsite will be added to the Hirer’s invoice. The Hirer must ensure that all underground services will be located and marked; any services not clearly marked and identified will not be the responsibility of RBR if they are damaged.

GAS APPLIANCES: All gas appliances are to be placed on a non-flammable surface. The appliance must be kept at a safe distance from any flammable material. The code of practice regarding gas appliances inside buildings or marquees can be located at Energy Safe Victoria or by their website. The code also details correct procedure of operation. The Hirer acknowledges the guidelines and ensures they will be followed. Any damage to either RBR’s items or that of another party due to a lack of following correct procedure will not be the responsibility of RBR.

The Hirer acknowledges that they have been trained or are competent in the operation of the item/s that are being hired.
